Welcome to Orca. These Terms of Service ("Terms") govern your access to and use of the Orca mobile application, website, and related services (collectively, the "Service"). By accessing or using Orca, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Service.
1. About Orca
Orca is a language learning application designed to help users improve speaking, listening, reading, pronunciation, and fluency through interactive games, real-life phrases, native human voices, and social learning features.
Orca is intended for personal, non-commercial educational use only.
2. Eligibility
To use Orca, you must:
- Meet the minimum age requirement required by your local law (or at least 18 years old, unless otherwise specified)
- Be legally capable of entering into a binding agreement
- Provide accurate and complete information when creating an account
By using Orca, you represent and warrant that you meet these requirements.
3. Account Registration
To access certain features, you may be required to create an account.
You agree to:
- Provide accurate, current, and complete information
- Keep your login credentials secure
- Be responsible for all activities that occur under your account
You are responsible for maintaining the confidentiality of your account and for any loss or damage resulting from unauthorized access.
4. Acceptable Use
You agree not to:
- Use Orca for any illegal, harmful, or abusive purpose
- Harass, threaten, impersonate, or harm other users
- Upload or share content that is offensive, hateful, or violates the rights of others
- Attempt to reverse engineer, modify, or interfere with the Service
- Circumvent any security, access controls, or usage limits
- Use automated systems (bots, scrapers) without permission
We reserve the right to suspend or terminate accounts that violate these rules.
5. User Content
Orca may allow you to submit or share content, such as profile information, messages, or learning activity ("User Content").
You retain ownership of your User Content. However, by submitting content, you grant Orca a non-exclusive, worldwide, royalty-free license to use, store, display, and process your content solely for the purpose of operating and improving the Service.
You are solely responsible for your User Content and any consequences resulting from it.
6. Voice, Audio, and Learning Features
Orca includes features such as:
- Speech recognition for pronunciation practice
- On-device offline text-to-speech for lessons
- Background music and sound effects
These features are provided for educational purposes only. Orca does not guarantee perfect accuracy in speech recognition, pronunciation feedback, or translations.
7. Social and Community Features
Orca may allow you to interact with other learners through chat, classrooms, leaderboards, or shared activities.
You agree to:
- Treat other users with respect
- Avoid abusive, discriminatory, or inappropriate behavior
We may remove content or restrict access to community features at our discretion to maintain a safe learning environment.
8. Subscriptions and Purchases (If Applicable)
Some features of Orca may require a paid subscription or in-app purchase.
If applicable:
- Prices and billing terms will be clearly disclosed before purchase
- Payments are processed through the app store provider
- Subscriptions automatically renew unless canceled
- Refunds are subject to the app store’s policies
Orca does not control app store refund decisions.
9. Intellectual Property
All content and materials provided by Orca, including text, audio, visuals, software, logos, and branding, are owned by Orca or its licensors and are protected by intellectual property laws.
You may not copy, distribute, modify, or create derivative works without prior written permission.
10. Termination
We may suspend or terminate your access to Orca at any time, with or without notice, if:
- You violate these Terms
- You misuse the Service
- We discontinue the Service
You may terminate your account at any time through the App.
Upon termination, your right to use the Service will immediately cease.
11. Disclaimer of Warranties
Orca is provided on an "as is" and "as available" basis.
We make no warranties, express or implied, including but not limited to:
- Fitness for a particular purpose
- Accuracy or reliability of learning outcomes
- Availability or uninterrupted access
Your use of Orca is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, Orca shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of progress, or loss of opportunities arising from your use of the Service.
In no event shall Orca’s total liability exceed the amount you paid to use the Service, if any.
13. Indemnification
You agree to indemnify and hold harmless Orca, its affiliates, and team members from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
14. Changes to These Terms
We may update these Terms from time to time.
When we do, we will update the "Last updated" date and notify you if the changes are material.
Your continued use of Orca after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to conflict of law principles.
